From September 11 to December 31, the Ministry of Justice will implement the ‘Special Self-Advance departure System for Illegal Foreigners’, which exempts fines and suspends entry restrictions for illegal aliens who leave the country on their own. This system is implemented in parallel with the crackdown in a situation where a regular crackdown system, such as a joint government crackdown, is in operation to establish order in the residence of foreigners.
It is implemented temporarily to provide incentives to illegal foreigners who wish to voluntarily leave the country and to give them the opportunity to do so.
The period is from September 11 to December 31, and all illegal aliens who leave the country on their own are eligible, but illegal immigrants, people using forged passports, criminal offenders, and those who fail to comply with departure orders are excluded. If an illegal alien voluntarily leaves the country during this period, the fine for illegal stay will be exempted and entry restrictions will be suspended.
However, even if you leave the country under this system, you cannot immediately receive a legal visa and come back to Korea.
Not only is it not on the Ministry of Justice's entry restriction list, but it is also impossible to issue a visa because the fact of illegal stay is registered in the immigration record. You must wait at least 5 years before you can apply for a visa again.
However, it is important to keep in mind that if an illegal alien does not leave the country during this voluntary departure period and is caught by crackdown, he or she may be subject to significant disadvantages, such as being subject to a fine of up to 30 million won and being placed on the entry ban list.
The Ministry of Justice plans to carry out the third joint government crackdown on illegal aliens in October of this year.
